CONDITIONS OF USE OF THE MANGO 

“DESIGN YOUR FUTURE” JOB WEBSITE

1.    INTRODUCTION

The present conditions, together with the Privacy Policy, regulate the access and use of the Mango “Design your Future” job website (hereinafter, the “Website”).

The Website is operated by PUNTO FA, S.L. (hereinafter, “Mango”), with registered address at C/ Mercaders 9-11 (Polígono Industrial Riera de Caldes), 08184 Palau-solità i Plegamans (Barcelona), Spain, recorded in the Companies Register of Barcelona in Volume 11195, Folio 156, Sheet B 167948 and holding Corporate Tax ID number B-59088948.

The purpose of the Website is to grant users access to the job offers of the different Mango Group companies and allow them to apply for any vacancies that may be of interest to them. Access to the Website and the use of its content and services implies full and unreserved acceptance of the present conditions of use in force and published on the Website at the moment users access the same.

If the user decides not to accept the present conditions, they should refrain from accessing the Website and/or using the contents and/or services available therein. Mango may, at any moment and without prior notice, modify the present conditions of use.

2.    INTELLECTUAL AND INDUSTRIAL PROPERTY

All intellectual, industrial and similar property rights of the Website and its contents, including but not limited to: images, sound, audio, video, designs, texts, graphics, logos, icons, colour combinations, structure, buttons, in addition to the software, commercial names, trademarks, works, illustrations, photographs and industrial drawings and any other symbols for industrial and commercial use are the property of Mango or of third-party owners of the same who have duly authorised their inclusion on the Website.

The reproduction, distribution and public communication, including making part or all of the content of the Website available for commercial purposes, in any medium and by any technical means, is strictly prohibited without the authorization of Mango.

Users agree to respect the intellectual and industrial property rights owned by Mango. Users may use the Website and its content for their own personal and private use. Any other use is not permitted. Users shall refrain from deleting, altering, eluding or tampering with any protective device or security system installed on the Website.

Mango reserves the right to modify, at any moment and without prior notice, the presentation, configuration and contents of the Website, and may alter, delete or add both the contents and services being provided by the same, and in the manner they are presented.

3.    USE OF THE WEBSITE

Users agree to use the Website content in an appropriate manner, undertaking to (i) provide true and exact information on the data requested in the registration form in the job offers; (ii) not incur in activities that are illicit, unlawful or contrary to good faith and public order; (iii) not publish content or propaganda of a racist, xenophobic or discriminatory nature based on race, gender, ideology, religion or act in any way contrary to the morality, public order, fundamental rights, public liberties, honour, intimacy or image of third parties and the applicable legislation in general; (iv) not damage the physical and logical systems of the Website, of Mango suppliers or third parties, or introduce or spread computer viruses into the network or any other physical or logical systems likely to result in the aforementioned damage; (v) not use the content of the Website and the information of the same for sending publicity, or sending messages for any other commercial purpose, or to collect and store the personal details of third parties.

Users undertake not to provide Mango with confidential or particularly sensitive information, such as: their racial or ethnic origin, their ideology or political, religious or philosophical convictions, their allegiance to political parties or trade unions, their physical or mental health, biometric data of genetic make-up, their sexual orientation, criminal record, etc.

4.     CONTENT AND SERVICES EXTERNAL TO THE WEBSITE

The Website may make available to users technical devices such as links, directories or search engines which allow them to access web pages owned and/or managed by third parties. The establishment of the link does not imply acceptance or approval on the part of Mango of its contents or services. Given that Mango has no control over pages linked via the links included on the Website, users acknowledge and accept that Mango shall not owe any liability for the content or services users may access on said pages, or for any product marketed on the same.

Mango shall not be liable for stored information and content, including but not limited to, on forums, chats, blog generators, comments, social networks or any other medium that allows third parties to publish content independent from the Website.

However, Mango shall make itself available to all users, authorities and security forces and actively collaborate in the withdrawal or blocking of any content that may affect or contravene national or international legislation, third party rights, morality or public order.

5.    GUARANTEES AND LIABILITY

Except where the law expressly states otherwise, or express indication to the contrary, users expressly recognize and accept that Mango shall not, under any circumstances, be liable for any damage of any nature that may be caused by the Website and the contents included therein, including but not limited to: (i) errors or omissions in said content; (ii) lack of availability and continuance of the functioning of the Website, its interruption, suspension or cancellation; (iii) the transmission of viruses or malicious or harmful software in the content, despite having adopted all the required technical measures to avoid it; (iv) any error or omission in the information contained on the Website, in addition to the lack of veracity, accuracy, exhaustiveness, pertinence and/or updating of its contents.

Mango shall not be responsible for delays or errors that occur in the access, functioning or operation of the Website, its Contents and/or Services, or any interruptions, suspensions or malfunctioning of the same, whenever they are caused by any situation of force majeure or unforeseen circumstances.

6.    APPLICABLE LAW AND JURISDICTION

Any issues derived from the access and/or use of the Website shall be deemed regulated and interpreted according to Spanish law. In cases where users are domiciled outside Spain, Mango and the user submit to the non-exclusive jurisdiction of the competent Courts in the Kingdom of Spain.
